Please read these Terms carefully before using ThreatAnalysis. They set out the rules for using our Services and the limits on how you may use the information you find.
1. Acceptance of these terms
These Terms & Conditions ("Terms") govern your access to and use of ThreatAnalysis ("the App", "we", "us", "our") and any related websites, applications, and services (collectively, the "Services"). By creating an account, running a search, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.
3. Not a consumer reporting agency
ThreatAnalysis is not a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"). The information we provide is compiled from public records and other publicly available sources and is not a "consumer report."
You may not use the Services or any information obtained through them for any purpose covered by the FCRA, including decisions about credit, insurance, employment, tenant screening, or eligibility for a license or benefit. For details, review our FCRA Compliance and Do's & Don'ts pages.
4. Permissible use of information
You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not use the Services to harass, stalk, threaten, defraud, or harm any person, or to violate any person's privacy or legal rights.
You are solely responsible for how you use any information obtained through the Services and for complying with all applicable federal, state, and local laws.
5. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your credentials.
6. Subscriptions, billing, and searches
Certain features and searches are provided on a paid or metered basis. By purchasing a subscription or running a billable search, you authorize us to charge the applicable fees to your payment method. Fees are non-refundable except where required by law.
You may cancel your subscription at any time; cancellation stops future charges but does not entitle you to a refund for the current billing period.
7. Accuracy and limitations
Public-records data can be incomplete, out of date, or contain errors, and records may pertain to individuals other than the person you are researching. The presence or absence of records does not guarantee that a person does or does not have a particular history. Always independently verify information before relying on it.
8. Intellectual property
The Services, including all software, text, graphics, and content we provide, are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your own lawful purposes. You may not copy, resell, scrape, reverse-engineer, or create derivative works from the Services without our written permission.
9. Prohibited conduct
You agree not to: (a) use automated means to access the Services except as expressly permitted; (b) interfere with or disrupt the Services or their infrastructure; (c) attempt to gain unauthorized access to any account, system, or data; (d) misrepresent your identity or affiliation; or (e) use the Services in any way that violates these Terms or applicable law.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that information will be accurate or complete.
11. Limitation of liability
To the fullest extent permitted by law, ThreatAnalysis and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless ThreatAnalysis and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
13. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or misused the Services. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive.
14. Governing law
These Terms are governed by the laws of the United States and the state in which we are established, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Services will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.
